1. General

1.1. These terms and conditions apply, to the exclusion of any other general terms and conditions, to all offers, orders, and agreements of Bilderdijk Wijnhuys.
1.2. These terms and conditions will be sent upon request.
1.3. Deviations from these terms and conditions are only valid if agreed upon in writing. In that case, the remaining provisions remain in full force.
1.4. Bilderdijk Wijnhuys reserves the right to amend these terms and conditions at any time.

2. Offers/agreements

2.1. All offers from Bilderdijk Wijnhuys are non-binding. Bilderdijk Wijnhuys reserves the right to withdraw offers and/or change prices.
2.2. All offers are subject to availability.
2.3. An agreement will only be concluded after acceptance by Bilderdijk Wijnhuys.
2.4. Bilderdijk Wijnhuys reserves the right to refuse orders or impose certain conditions. If an order is accepted, it will be delivered within 3 business days. 2.5. The minimum age for all orders is 18 years.
2.6. The listed prices include excise duty and VAT, but exclude delivery charges. For orders over €75, we deliver free of charge to a single address in the Netherlands. For orders under €75, delivery is only possible upon consultation, and a fee will be charged.
2.7. Wines are sold individually. 2.8. Payment must be made in advance and without any right to offset or discount, not even in the event of complaints. Payment must be made by a one-time direct debit (or by one of the methods and within the timeframe specified during the ordering process). The invoice will be sent to you by mail and/or email. The date of payment is the date the order is credited to Bilderdijk Wijnhuys' bank account.
2.9. If the payment term is exceeded, you will owe default interest of 2% per month or part thereof on the outstanding amount from the following day. For each reminder from Bilderdijk Wijnhuys, you will owe an amount of
€20 in administration costs are due. If, even after a reminder, payment is not made, not paid in full, or not paid before the payment deadline set in the reminder, Bilderdijk Wijnhuys is entitled to charge extrajudicial (collection) costs, which amount to at least 15% of the outstanding amount, with a minimum of €200. In addition, Bilderdijk Wijnhuys is entitled to the full amount of the actual extrajudicial collection costs if these are higher.
2.10. If you default on any payment, Bilderdijk Wijnhuys is entitled to terminate or suspend the performance of the agreement and related agreements.
2.11. If Bilderdijk Wijnhuys changes its price between placing your order and its fulfillment, you are entitled to cancel your order within ten business days of notification of the price increase by Bilderdijk Wijnhuys. If payment has already been made at that time, any payments already made will be refunded as soon as possible, but no later than within 30 days.
2.12. Ownership of the delivered products will only be transferred once you have paid everything you owe to Bilderdijk Wijnhuys under any agreement.
2.13. Bilderdijk Wijnhuys is not liable for the failure or incorrect transmission of orders and communications as a result of the use of the internet or any other means of communication between you and Bilderdijk Wijnhuys, or between Bilderdijk Wijnhuys and third parties, unless there is intent or gross negligence on the part of Bilderdijk Wijnhuys.
2.14. The information published on the Bilderdijk Wijnhuys website, of whatever nature, is provided for informational purposes only, based on sources that Bilderdijk Wijnhuys believes to be reliable, but without any guarantee regarding the reliability, currency, completeness, or quality or accuracy of its content.

3. Delivery

3.1. Delivery takes place exclusively within the Netherlands and takes approximately seven business days, unless otherwise indicated on the Bilderdijk Wijnhuysen website or in the order confirmation. Delivery will in any case take no longer than 30 days after payment.
3.2. The stated delivery times are for guidance only. Exceeding any delivery time does not entitle you to compensation, nor does it entitle you to cancel your order or terminate the agreement, unless the delivery time is so late that you could not reasonably have been expected to maintain the agreement. In that case, any payments already made will be refunded as soon as possible, but no later than within 30 days.
3.3. Delivery will be made exclusively to the address specified in the order. If the agreed delivery time is exceeded, you will be notified in writing or by telephone.
3.4. Bilderdijk Wijnhuys is entitled to deliver the order in parts.
3.5. Bilderdijk Wijnhuys is authorized to use third parties to fulfill your order.

4. Complaints

4.1. The risk of the product passes to you upon delivery. You are obligated to inspect the products for breakage and to verify that they conform to the agreement upon delivery. If they do not, you must notify Bilderdijk Wijnhuys in writing as soon as possible, and in any case within seven business days of delivery.
4.2. Bilderdijk Wijnhuys will attempt to resolve any complaints as quickly as possible and will inform you of them as soon as possible.
4.3. If it is demonstrated that the products do not comply with the agreement, Bilderdijk Wijnhuys has the option to replace the products in question with new products upon their return, or to refund the invoice value within 30 days if payment has already been made.
4.4. If you do not wish to accept a product for any reason, you have the right to return it to Bilderdijk Wijnhuys at your own expense within fourteen business days of delivery.
4.5. Returns will only be accepted if the product packaging is undamaged.
4.6. Any liability of Bilderdijk Wijnhuys shall lapse in the event of (re)sale or delivery by you to third parties.

5. Force Majeure

5.1. Bilderdijk Wijnhuys reserves the right to suspend order fulfillment or terminate the agreement without judicial intervention in the event of force majeure. You will be notified of this in writing. In such a case, Bilderdijk Wijnhuys will not be liable for any damages.
5.2. Force majeure is defined as any failure that cannot be attributed to Bilderdijk Wijnhuys because it is not its fault and/or is not its responsibility, including, but not limited to, business interruptions, internet connection disruptions, transport delays, strikes, and failure or late delivery by suppliers.

6. Privacy

6.1. Bilderdijk Wijnhuys respects the privacy of all users of its site and ensures that the personal information you provide is treated confidentially. This information will only be used with your permission and will not be sold to third parties. However, it may be made available to third parties involved in processing your order.
6.2. With your consent, your data will also be used to inform you about website developments and special offers and promotions. If you do not wish to receive this information, please let us know by sending an email to Customer Service.
6.3. Employees and third parties engaged by Bilderdijk Wijnhuys are obligated to respect the confidentiality of your data.
6.4. Processing of the data will take place in accordance with the law.

7. Intellectual property

7.1. You must fully and unconditionally respect all intellectual and industrial property rights that apply to the products supplied by Bilderdijk Wijnhuys, as well as the website and the texts and images used by Bilderdijk Wijnhuys.
7.2. Any use of these rights is not permitted without prior written permission from Bilderdijk Wijnhuys.

8. Applicable law and competent rights

8.1. All agreements with Bilderdijk Wijnhuys are exclusively governed by Dutch law.
8.2. All disputes between the parties will again be submitted exclusively to the competent court in Haarlem.
8.3. Bilderdijk Wijnhuys adheres to the code of conduct of the Dutch Thuiswinkel organization.
